This photo release and waiver of liability (the “Release”) is entered into as of March, 2020 by the registered player below “Player”, in favor of “Ledbetter Basketball” with a principal place of business at Saint Louis, MO 63117.

1. PERMISSION TO MAKE AND USE PICTURES/RECORDINGS.
The Player grants and its employees, agents, independent contractors, licensees, successors, and assigns “Ledbetter Basketball” permission and the full and irrevocable right to record the Player’s likeness, image, voice, appearance, and performance on photographs, film, videotape, audiotape, computer files, or other media (the “Recordings”) and to use, reuse, edit, exhibit, license, distribute, and/or otherwise exploit the Recordings, in whole or in part and in conjunction with the Player’s name (or fictitious name) and biographical material, in, on, or in connection with “Ledbetter Basketball” “Brett Ledbetter” “FilmRoomTV” and any advertising, underwriting, and publicity in connection therewith (the “Recordings Use”).
2. RIGHTS AND OBLIGATIONS.
The Player grants and assigns to Ledbetter Basketball and their Agents all right, title, and interest in and to the Recordings, including, but not limited to, copyright. The Player understands and agrees that photographs and recordings shall be the sole property of Ledbetter Basketball, and that the Player shall have no right to: (i) inspect or approve the Recordings; (ii) inspect or approve any other recordings, text, graphics, images, or other content created in connection with or combined with the Recordings; or (iii) receive any royalties or other compensation arising from or related to the Recordings Use.
3. RELEASE
The Player agrees to release, discharge, and hold harmless Ledbetter Basketball and Ledbetter Basketball’s Agents from any and all damages, liabilities, costs, expenses, claims, and/or judgments of any kind or nature whatsoever arising from the Photographs, Recordings Use, including, but not limited to, those based on copyright infringement, invasion of privacy, right of publicity, libel, defamation, or false light. The Player acknowledges and agrees that this Release is binding on the Player, and the Player’s heirs, legal representatives, and assigns.
4. TALENT’S REPRESENTATIONS AND WARRANTIES.
I, the undersigned, do hereby consent the use of, image, voice, or both of the minor child under the age of 18 described below, in (1) the video, photograph, or audio recording described below; and (2) any video, photograph, or audio recording reproduced either in whole or in part from the video, photograph or audio recording described below: regardless of whether these materials are used for sale, fundraising, advertising, publicity, or any other purpose on behalf of Ledbetter Basketball. I warrant that I am the parent or legal guardian of the minor described below and have the full right and authority to grant this consent on behalf of such minor. In addition, I waive all claims to compensation or damages based on the use of such minor’s image or voice, or both, by the Filmmaker. I also waive any right to inspect or approve the finished photograph or video or audio recording. I understand that this consent is perpetual, that I may not revoke it, and that it is binding on the minor, our heirs and assigns. I warrant that I am at least 18 years of age and that I am competent in my own name insofar as this consent is concerned. I further attest that I have read this consent form and fully understand its contents.
5. WAIVER OF LIABILITY
I request that the player I’m registering will be allowed to participate in the Ledbetter Academy. The player mentioned also has my permission to attend all sessions.
This agreement absolves Ledbetter Basketball, any facilities that are used for training (including faculty, volunteers, and hired service personnel) and any and all members of its governing boards of any responsibility for the safety, welfare, health, and well-being of the child named in the registration, and assumes personally and exclusively all responsibility and liability for accident, injury, etc., which may occur to the registered named child during training or traveling to and from training.
I understand that to participate in training I must comply with the regulations stated here, in the rules and those given by the trainers.
